General

When a user browses the CMS Measures Inventory Tool (CMIT), information about their visit can be collected. CMIT automatically collects and temporarily stores the following information about a user's visit:

CMIT uses internal and third party information analytics tools, such as Google Analytics, to collect and aggregate this information to create reports and analyses, which are used to help CMIT make its websites more useful to visitors. These information sets and reports are only available to web managers and other designated staff who require this information to perform their duties. CMIT retains the information from these tools as long as needed to support the CMIT mission. This information includes no personally identifiable information (PII).

The CMS Measures Inventory Tool (CMIT) requires user login. In order to authenticate the user, CMIT maintains account information for each user. The account record includes the user's name (last first, middle initial, title, and suffix), the user's e-mail address, and the user's password. CMIT will retain this information only as long as the account is active and for the purpose of maintaining audit trails as required by federal regulations and guidelines. CMIT will safeguard the information provided to us in accordance with the Privacy Act of 1974, as amended (5 U.S.C. Section 552a).

All communications addressed to CMIT or the mmssupport@battelle.org e-mail address are maintained, as required by law, for historical purposes, and are protected by the Privacy Act which restricts our use of them, yet permits certain disclosures.

CMIT displays a Privacy Act Notification Statement prominently and conspicuously. The notice must address the following 5 criteria:

While CMIT will make every attempt to protect the personal information that users share, electronic mail is not secure against interception. If a communication is sensitive in nature, a user is advised to send it by postal mail instead.

CMIT does not disclose, give, sell or transfer any personal information about visitors to CMIT, unless required for law enforcement or by statute.

CMIT is maintained by the U.S. Government. It is protected by various provisions of Title 18, U.S. Code. Violations of Title 18 are subject to criminal prosecution in federal court. For site security purposes and to ensure that this service remains available to all users, CMIT employs software programs to monitor traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. In the event of authorized law enforcement investigations, and pursuant to any required legal process, information from these sources may be used to help identify an individual.

Cookies

The Office of Management and Budget Memo M-10-22, Guidance for Online Use of Web Measurement and Customization Technologies allows Federal agencies to use session and persistent cookies. When visiting CMIT, a small text file called a "cookie" may be placed on a user's computer. This allows CMIT to collect non-PII (personally identifiable information) information while the user is navigating through the website. CMIT uses one type of cookies on its website:

If a user does not want cookies placed on their computer, they can set their browser to block them. Session cookies are required for the proper operation of CMIT. However, the session cookie does not contain PII and expires when a user leaves CMIT. Blocking only persistent cookies will not affect a user's experience with CMIT.

CMIT is comprised of various Web pages operated by Battelle on behalf of the Centers for Medicare & Medicaid Services (CMS). CMIT is offered to you conditioned on your acceptance without modifications of the terms, conditions, and notices contained herein. Your use of CMIT constitutes your agreement to all such terms, conditions, and notices.

CMIT reserves the right to change the terms, conditions, and notices, under which CMIT is offered.

Information contained in this system is subject to the Privacy Act of 1974 (5 U.S.C. 552A, as amended). Unlawful or Prohibited Use

As a condition of your use CMIT, you warrant to CMIT that you will not use CMIT for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use CMIT in any manner which could damage, disable, overburden, or impair CMIT or interfere with any other party's use and enjoyment of CMIT. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through CMIT.

Government System Usage Policy

CMIT is provided only for official business use and is funded by CMS. This system is monitored to ensure proper operation, to verify the functioning of applicable security features and for other like purposes. Anyone using this system expressly consents to such monitoring and is advised that if such monitoring reveals evidence of possible criminal activity, system personnel may provide the evidence of such activity to law enforcement officials. Unauthorized attempts to upload or change information; to defeat or circumvent security features; or to utilize this system for other than its intended purposes are prohibited.

UNAUTHORIZED ACCESS TO THIS COMPUTER SYSTEM IS PROHIBITED BY LAW (REFERENCE TITLE 18 U.S.C., SECTION 1030) IF YOU ARE NOT AUTHORIZED TO ACCESS THIS SYSTEM YOU MUST SIGN OUT IMMEDIATELY OR EXIT.

Federal, State, and⁄or local laws may provide criminal penalties for any person illegally accessing or using a Government owned or operated computer system.

Additional Terms for Account Holders

CMIT is funded by The Centers for Medicare & Medicaid Service (CMS) for use by the measure development community. The following Terms of Use is designed to inform users who have registered and received account privileges in CMIT. The additional terms are specific to the practices regarding collection, use, and disclosure of information that you may have access to as a signed-in user of CMIT. The entire Terms of Use applies to account holders.

In order to ensure the integrity, confidentiality, availability and security of information maintained by CMIT, and to permit appropriate disclosure and use of such data as permitted by law; the Account Holder agrees to comply with the following specific paragraphs. The Account Holder represents and warrants further that he⁄she shall not disclose, release, reveal, show, sell, rent, lease, loan, or otherwise grant access to their User ID and password to CMIT to any individual(s). The Account Holder agrees to notify the CMIT Help Desk should they suspect their User ID and password to be compromised, such that it should be deleted and a new User ID and password should be issued.

The Account Holder agrees to establish appropriate administrative, technical, and physical safeguards to protect the confidentiality of the information accessed through CMIT and to prevent unauthorized use or access to it. The Account Holder agrees that no findings, files, or information derived from the use of CMIT may be released to unauthorized individuals.

The Account Holder agrees that in the event CMIT Security determines or has reasonable belief that the User has made any unauthorized disclosure(s), their access will be revoked. The Account Holder acknowledges that criminal, administrative, or civil penalties under the Privacy Act may apply if it is determined that the individual knowingly and willfully released the information under false pretenses.

By accepting this agreement, the Account Holder agrees to abide by all provisions set out in this Agreement for protection of the data and acknowledges having received notice of potential criminal, administrative, or civil penalties for violation of the terms of the Agreement.
